These Terms and Conditions ("Terms") govern your access to and use of our website (www.resonatesoundapp.com), mobile application and other services provided by Resonate Sound GmbH (collectively, the "Service"). By accessing, downloading, installing or using the Service, you agree to be legally bound by these Terms. If you do not agree, have read or fully understood, please do not use our Service.

2. Eligibility

To use Resonate, you must be at least 16 years old or have parental consent if you are under 16. By using the Service, you represent and warrant that you meet these requirements.

3. Account Registration & Security

  • You need to create an account to access the Service.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree to notify us immediately of any unauthorized use of your account.

4. Subscriptions & Payments

  • Resonate offers free (trial) and paid subscription plans. By subscribing, you authorize us to charge your payment method at the applicable rate.
  • Subscription fees are billed in advance and are non-refundable except where required by law.
  • You may cancel your subscription at any time through your account settings.
  • Prices may change, and we will notify you in advance of any price adjustments.
  • Each subscription is intended for individual use only. Sharing login credentials, reselling, or distributing access to Resonate’s paid content is strictly prohibited and may result in account termination without a refund and legal actions.
  • Invite a friend: Resonate may offer you the ability to send your loved ones an email/note requesting they join the Service (“Invite a Friend”). We reserve the right to impose limits on the number of invites at any time. You hereby give us the authorization to facilitate the sending of emails/text messages/etc. on your behalf to the extent you wish to use this Service.

5. User Conduct

By using our Service, you agree:

  • Not to violate any applicable laws or regulations.
  • Not to distribute, copy, alter or reverse-engineer our content.
  • Not to use the Service in any commercial way, without explicit permission by Resonate.
  • Not to interfere with the proper functioning of our Service.
  • Not to use the Service for any unlawful, fraudulent, or malicious purposes.

6. Intellectual Property

  • All content, trademarks, and intellectual property within the Service belong to Resonate or its licensors.
  • You may not use, copy, distribute, or modify any content from Resonate without our explicit permission.

7. Third-Party Services

Resonate may contain links to third-party services. We are not responsible for the content, policies, terms or practices of third-party websites.

8. Termination

  • We reserve the right to suspend or terminate your account if you violate these Terms.
  • You may stop using the Service at any time. Termination does not entitle you to a refund of any fees paid.

9. Disclaimers & Limitation of Liability

  • Resonate provides content for relaxation and meditation purposes only. It is not a medical service and should not be considered a substitute for professional medical advice.
  • By accessing the Service, you acknowledge and agree that your usage of any practices or activities is completely at your own risk. Resonate and all of its employees/team, will not be liable for any physical or mental injury or illness that may result whether directly or indirectly, from any of our Services.
  • Do not use Resonate while you are driving any vehicle or doing anything other than sitting still or lying down to relax.
  • We do not guarantee uninterrupted availability of the Service and disclaim all liability for technical failures, service interruptions, or content errors.
  • To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Service.

Your privacy is important to us. Our Privacy Policy explains how we collect, store, and process your data.

11. Communications

  • Push Notifications: When you download and install Resonate on your device, you will be asked to allow push notifications. You may turn off notifications by deselecting them in your “settings” under your profile.
  • Emails: During onboarding, you may opt to receive emails concerning Resonate products and services, as well as those of third parties. There is an option to opt out of promotional emails by following the unsubscribe instructions in the promotional emails themselves.

12. Governing Law & Jurisdiction

These Terms are governed by Swiss law. Any disputes will be resolved in the courts of Zürich, Switzerland.

13. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will notify you through the Service or by email. Continued use of the Service after changes constitutes acceptance of the revised Terms.
